Coonamble man jailed for twelve months after vicious assaultBarry Murray, aged 34, appeared at Dubbo Local Court on 21 September and was sentenced to 12 months behind bars

Coonamble man Barry Murray will spend his next twelve months behind bars after assaulting an unsuspecting victim at a licensed venue in Coonamble on 5 August this year.


Murray, aged 34, appeared remotely at Dubbo Local Court on Thursday 21 September for sentencing via an audio-visual link from Bathurst Correctional Centre where he was held in custody.


He pleaded guilty to the charge of 'assault occasioning actual bodily harm' and magistrate Garry Wilson sentenced him to eighteen months in prison, with a twelve-month non-parole period.



Following sentencing, Murray listed his sentence for a severity appeal at the Dubbo District Court on 2 November.


The assault occurred late on Saturday 5 August in the smoker's area at a licensed premises in Coonamble and resulted in the victim, a male aged 53, presenting to hospital with swelling and pain to his face and head.


CCTV footage shows the victim standing at a bar table talking to a fellow patron in the smoker's area with a beer in hand.


Murray then entered the smoking area, walked directly towards the unsuspecting victim and punched him in the face, knocking him to the ground and spilling his beer.


Murray then repeatedly punched and kicked the victim's face and head while he was on the ground, also stomping on his head.


Other patrons eventually restrained Murray and he left the smokers area.


The victim appeared at the Coonamble Multipurpose Health Service following the incident to treat pain and swelling in his face and head when he reported the incident to police.


Following inquiries Murray was arrested at Coonamble Police Station on Tuesday 8 August.


The Dubbo Daily Liberal reported on the court proceedings on 26 September, quoting Magistrate Wilson with the following.


"The police 'facts' are quite emotive relating to the offending and I tend to accept the observations in that regard, there was multiple punches, kicking, stomping and you are fortunate no more serious injuries were caused by your degree of violence," said Mr Wilson to Mr Murray.


"It was an unsuspecting victim with no provocation at all, there's no doubt you solve all your problems by serious acts of violence."
